Terms of Service

These Terms of Service ("Terms") govern your use of the Stooly mobile application ("Stooly" or the "App") operated by Four Pi Systems LLC ("we," "our," or "us"). By downloading, installing, or using Stooly, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use Stooly. If you are under 18, you represent that you have your parent or guardian's consent to use the App. By using Stooly, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

Stooly is an iOS application that uses artificial intelligence to analyze photos of bowel movements and provide general wellness information about digestive health. The App provides:

• AI-powered photo analysis and Bristol Scale classification
• A Gut Health Score (0–100) based on tracked entries
• 30-day trend analysis and pattern recognition
• General wellness tips and educational information

3. Medical Disclaimer and Limitation of Purpose

THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. PLEASE READ IT CAREFULLY.

Stooly is designed for general wellness and informational purposes only. The App, including all content, features, scores, classifications, insights, tips, and recommendations provided within it:

• Is NOT a medical device and has not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body.
• Is NOT intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition, including but not limited to gastrointestinal diseases, colorectal cancer, inflammatory bowel disease, irritable bowel syndrome, or any other condition.
• Does NOT provide medical advice. Nothing in the App should be construed as professional medical advice, opinion, or recommendation.
• Is NOT a substitute for professional medical care. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have seen or read in Stooly.
• Should NOT be relied upon for medical decisions. If you have any concerns about your health, including the presence of blood, persistent changes in bowel habits, unexplained symptoms, or any other health concern, contact your healthcare provider immediately.

The AI analysis, Gut Health Score, trend data, and wellness tips provided by Stooly are algorithmic outputs based on limited visual data and statistical patterns. They are not clinically validated, may contain errors, and should be understood as general informational estimates only.

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. DO NOT USE STOOLY AS A SUBSTITUTE FOR EMERGENCY MEDICAL CARE.

By using Stooly, you acknowledge and agree that you understand these limitations and accept full responsibility for any decisions you make regarding your health.

4. Your Account

To use Stooly, you must create an account using Sign in with Apple. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to:

• Provide accurate information during account creation
• Keep your Apple ID credentials secure
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these Terms.

5. Subscriptions and Payments

5.1 Free and Paid Features

Stooly offers a limited free tier and paid subscription plans that unlock additional features. Current subscription options and pricing are displayed within the App.

5.2 Billing

All subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms of purchase. We do not process payments directly or have access to your payment information.

5.3 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged.

5.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of your current billing period. Refund requests must be directed to Apple, as they handle all payment processing.

5.5 Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing cycle, and you will be notified in advance as required by Apple's policies.

6. Acceptable Use

You agree not to:

• Use Stooly for any unlawful purpose or in violation of any applicable laws
• Submit content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to our servers, systems, or other users' accounts
• Reverse engineer, decompile, or disassemble the App or any part of it
• Use the App to develop a competing product or service
• Interfere with or disrupt the integrity or performance of the App or its servers
• Use automated systems, bots, or scripts to access or interact with the App
• Misrepresent your identity or impersonate another person

7. Intellectual Property

All content, features, functionality, designs, text, graphics, logos, and software in Stooly are owned by Four Pi Systems LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

You retain ownership of any photos you capture using the App. As described in our Privacy Policy, photos are processed for analysis and immediately discarded.

8. Disclaimer of Warranties

STOOLY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content, analysis, score, classification, or information provided by the App.
• Any warranty that the AI analysis will correctly identify or classify any health-related condition or characteristic.

You acknowledge that AI-powered analysis is inherently imperfect and may produce incorrect, incomplete, or misleading results. You use the App and rely on its outputs entirely at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FOUR PI SYSTEMS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses;
• Damages arising from your use of or inability to use the App; any errors, inaccuracies, or omissions in the App's content or analysis; any health decisions or actions taken based on information provided by the App; any unauthorized access to or alteration of your data; or any other matter related to the App;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total aggregate liability to you exceed the amount you have paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Four Pi Systems LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of any third party
• Any health decisions or actions you take based on information provided by the App

11. Termination

We may suspend or terminate your access to Stooly at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and associated data in accordance with our Privacy Policy
• Sections 3, 8, 9, 10, 12, and 13 shall survive termination

You may terminate your account at any time by deleting it through the App's Settings screen.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the State of Delaware or remotely at your election.

You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Four Pi Systems LLC.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

13. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Four Pi Systems LLC regarding Stooly.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
• No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Providing an in-app notification for significant changes

Your continued use of Stooly after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.
